Terms of Sale

1. DEFINITION AND SUBJECT OF THE CONTRACT
1.1 – This contract ("Contract") is a distance contract pursuant to articles 50 et seq. of Legislative Decree 6 September 2005, no. 206 ("Consumer Code"). The purpose of the Contract is the sale of movable goods between Zavatti S.r.l., with registered office in Poggio Rusco MN Via Abetone Brennero 144 and operating office in Poggio Rusco MN Via Abetone Brennero, 144, Tax Code 02386910208, VAT no. 02386910208 ("Zavatti Srl") and the consumer (the "Customer"). The Contract is concluded directly through the acceptance by Zavatti Srl of a purchase proposal issued by the Customer by telephone or via the internet on the website (the "Site") and/or through other distance selling systems of Zavatti Srl, based on the methods described in article 3 below.
1.2 These general conditions of sale ("General Conditions") and, in particular, the information referred to in art. 52 of the Consumer Code repeated to the Customer by telephone and reported on the Site, will remain valid and effective until they are modified and/or integrated by Zavatti Srl. Any modifications and/or additions to the General Conditions will be effective from the date on which they are communicated to the public and will apply to sales made from that date. The latest updated version of the General Conditions is available on the Site.

2. PRICES
The sales prices of the products illustrated on the Site and/or through any other distance selling systems of Zavatti Srl include VAT and all other taxes. Delivery costs are indicated on the Site and/or through any other distance selling systems of Zavatti Srl and, in the case of a telephone order, repeated to the Customer by the operator.

3. PURCHASE AND PAYMENT METHODS

3.1 - The Contract by telephone is perfected by communicating to the Customer (who has contacted Zavatti Srl by telephone and, on that occasion, submitted a purchase proposal also providing the operator with the data necessary for the registration procedure of his name, the purchase order and the chosen payment method) that the proposal is accepted.

3.2 - In case of purchase proposals sent via the Site, the Customer will receive a summary e-mail from Zavatti Srl, with which he will be informed that his purchase proposal is being processed and will be considered accepted, unless otherwise communicated by e-mail or telephone by Zavatti Srl within 3 (three) calendar days from the receipt of the summary e-mail. After this deadline, the Contract via the internet is to be considered perfected.

3.3 - The Customer will be allowed to choose one of the following payment methods:
• CASH to the courier who delivers the product;
• advance bank transfer;
• credit card;
• Paypal;
• Installments Online (in collaboration with SELLA Personal Credit S.p.a.).

Description of the Installments Online service

The offer is for a limited time; Zavatti Srl and SELLA Personal Credit S.p.A. reserve the right to change the conditions and terminate the offer freely, with a few days' notice.
The offer is valid for all orders from a minimum of €150.00 up to €8,000.00
Thanks to an agreement with SELLA Personal Credit S.p.A. – a financial company for consumer credit of the Banca Sella Group – Zavatti Srl offers you the possibility to pay for your purchases in convenient installments that you can debit from your bank account.
Personalized financing can be requested by choosing from the different payment methods available at the end of the purchase process.
By choosing this form of payment, you will be transferred, for the completion of the order, to the SELLA Personal Credit S.p.A. website (www.sellapersonalcredit.it), where you can choose the type of installment plan. After reviewing the financing conditions and the relative interest rates, you will then be asked for some personal data (occupation, family composition, income).

The granting of financing and the completion of the order are subject to prior approval by SELLA Personal Credit S.p.A.. The transaction always takes place in a protected manner, on the SELLA Personal Credit S.p.A. website, with 128-bit encryption to ensure an adequate level of confidentiality of the information sent. The data is provided directly to SELLA Personal Credit S.p.A. and will not be made available to Zavatti Srl for any reason.

At the end of filling out the form, SELLA Personal Credit S.p.A. will provide one of these three responses in real time:
• Provisional approval of the financing.
• Request for further information for processing the application.
• Non-approval of the financing.

In case of provisional approval, the Customer will be invited to print the pre-filled online contract which must be sent back signed, attaching the required documentation:
• a copy of the identity document;
• a copy of the tax code;
• a copy of the last payslip or income statement;
• an original utility bill (electricity, gas, telephone), which will be returned upon your request.

Up to this point, the Customer is not obliged to pay anything.
Once all the documentation has been received, SELLA Personal Credit S.p.A. will issue final approval, sending a confirmation e-mail, while Zavatti Srl will ship the goods to the address indicated at the time of the order. Upon receipt of the goods, the Customer will not have to pay anything.
The entire procedure takes 4-5 working days. To speed up order fulfillment as much as possible, it is essential that the Customer sends the documentation and the signed contract as soon as possible, preferably using priority mail or electronically (if in possession of a digital signature).

The advantages of installment purchasing: By purchasing in installments on the Zavatti Srl Website, you can have what you want at home immediately, even before you start paying. The first installment is due 30 days after the amount is disbursed by the financial company.
In this way, you have the possibility to defer payment and plan your budget without disinvesting your savings.
Conditions for purchase: Financing can be requested, for purchases on the Zavatti Srl Website, by a private consumer, for a minimum amount of €150.00 (VAT included) and for a maximum of €8,000 (VAT included).
With this form of payment, a maximum of five items can be purchased.

An invoice will not be issued, only a simple fiscal receipt, unless specifically requested.

The transport costs indicated refer exclusively to Italian territory.

4. DELIVERY OF PRODUCTS – COMPLAINTS

4.1 – Zavatti Srl delivers the products to the address indicated by the Customer within 30 (thirty) days from the conclusion of the Contract.

4.2 – Any complaint may be forwarded to the following address: Zavatti S.r.l. – Via Abetone Brennero, 144 – 46025 Poggio Rusco MN.

If the courier assigned to deliver the goods at home does not find anyone, they will leave a missed delivery notice and attempt to redeliver the goods the next day. If the second attempt is also unsuccessful, the order will be held at the local branch. It is possible to reschedule the delivery by contacting this branch at the phone number indicated on the notice left by the courier.
The costs for opening the storage are at the customer's expense.
The courier delivers "to the side" of the vehicle, the unloading service with a tailgate is available upon request and subject to additional costs.

5. PRODUCT AVAILABILITY
Zavatti Srl accepts Customer orders within the limits of the quantities of the requested products available in stock. Therefore, Zavatti Srl's acceptance of the purchase proposal submitted by the Customer is subject to the availability of the products in stock. Zavatti Srl undertakes to promptly communicate to the Customer any unforeseen stock depletion due to excess demand or other causes.

6. WARRANTIES AND ASSISTANCE

For products purchased by the Customer, the regulations regarding warranties and assistance related to the sale of consumer goods apply to Zavatti Srl.

WARRANTIES:
One year, if invoiced to a company or professional (VAT subject) (pursuant to art. 1495 c.c.);
Two years, if fiscally described as sold to a private individual (Legislative Decree 206/2005).

7. CUSTOMER OBLIGATIONS
The Customer declares and guarantees: to be a consumer as provided for in art. 3 of the Consumer Code; to be of legal age; that the data provided by the same for the execution of the Contract are correct and truthful.

8. RIGHT OF WITHDRAWAL

8.0 – To whom it applies: The right of withdrawal does not cover every buyer. The first limitation is its application only to consumers. Despite past attempts to interpret this term broadly, it is now established that it can only refer to a physical person acting outside their professional activity. The Civil Code, in fact, defines it this way: "a consumer is a physical person acting for purposes unrelated to any entrepreneurial or professional activity carried out" (art. 1469 bis). In essence, companies and professionals with a VAT number cannot exercise the right of withdrawal for purchases made in that capacity.

8.1 – The Customer has the right to withdraw from the stipulated contract, without any penalty and without specifying the reason, within 14 days of receiving the products. The Customer may exercise the right of withdrawal, within the aforementioned term, by expressing it through a written communication to the registered office of Zavatti Srl referred to in art. 4, to be sent by registered letter with acknowledgment of receipt or by telegram, telex, email or fax.

8.2 – The Customer who intends to avail himself of the right of withdrawal must return the products to the address indicated on the invoice, following the instructions therein, within 14 days of receipt of the products. Pursuant to article 55, paragraph two, of the Consumer Code, the Customer will not have the right of withdrawal in the following cases:
• Partial use of the goods and any consumable materials
• The absence of the external packaging and/or the original internal packaging;
• The absence of integral elements of the product (accessories, cables, manuals, parts, etc…);
• Damage to the product for reasons other than its transport
• Customers who purchase with a VAT number cannot exercise the right of withdrawal
• Supply of products custom-made or personalized, or which, by their very nature, cannot be returned or are liable to deteriorate or expire rapidly
• Used, reconditioned or repaired products
• Products ordered from suppliers specifically for the customer
• In the cases indicated above, Zavatti Srl will return the purchased item to the sender, charging the shipping costs to the same

The refund will be made by e-coupon redeemable on our site.

8.3 – The costs of returning the products are borne by the Customer. Zavatti Srl will refund, within 20 days from the date of receipt of the products by the Customer: the full price paid by the Customer in case of return of the product complete with all its parts and functionalities; or the part of the price equivalent to the product actually returned by the Customer who has used the product significantly and/or in such a way as to significantly diminish its value.
• The purchased goods must be intact and returned in their original packaging, complete in all their parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); to limit damage to the original packaging, we recommend, where possible, inserting it in a second box; in all cases, the application of labels or adhesive tapes directly on the original product packaging should be avoided;
• Shipping, until certified receipt at our warehouse, is under the complete responsibility of the customer;
• Zavatti Srl is not responsible in any way for damage or theft/loss of goods returned with uninsured shipments.

We reserve the right to change the characteristics of our products, in whole or in part, without prior notice.
The price published at the time of the order is binding.
